Terms and Conditions

The core in one paragraph: as a business you buy measurement volume per month, billed monthly, cancellable monthly or with a yearly commitment at a lower rate. Above your budget, measurements are skipped, not billed afterwards. Measurements describe the behaviour of AI assistants at the moment of measurement; we guarantee the quality of the measurement, not its outcome. Your data stays yours. The rest of this page spells that out.

1. The service and who provides it

Geony is an online service that measures whether brands are mentioned in the answers of AI assistants, which sources feed those answers, and turns that into reports and work lists. Which assistants we measure is shown in the app and can change: providers are added or dropped when their technology or terms give reason to.

The service is provided by Artiq Motion B.V., Heliumstraat 8, 7463 PL Rijssen, KvK 67683428, btw-nummer NL002262657B49, under the Geony trademark. Where it says "we" or "Geony", we mean that company. These terms apply to all use of geony.ai, app.geony.ai and the Geony API.

2. Business use and your account

Geony is a service for businesses. By creating an account you declare that you are acting in the exercise of a profession or business, even as a sole trader. Legal rules that protect only consumers, such as the cooling-off period for distance purchases, therefore do not apply.

You create an account with Google, Microsoft or with email and password. You are responsible for what happens under your account, for the questions, brands and competitors you set up, and for who you give access to. API keys are secret: you do not share them and you tell us immediately if one has leaked. Misuse, such as attempts to use the measurement infrastructure as generic AI access or to load the service beyond normal use, can lead to a block.

3. Measurements, credits and subscriptions

Subscriptions grant a measurement volume per month (Start: 300, Groei: 1,000, Bureau: 5,000) and are billed monthly in advance via Stripe. There are two terms: cancellable monthly, or a yearly commitment at a lower monthly rate, which runs for at least twelve months and then renews tacitly per year. In both cases the measurement volume tops up each month; the monthly remainder lapses, purchased packages do not. Enterprise subscriptions have their own volume and price agreed in writing. One measurement is one question, asked once to one assistant, whether via the app or via the API. If your volume is used up, measurements are skipped; measuring is never silently continued and billed afterwards. Separate credit packages can be purchased and do not expire as long as your account exists.

All prices are exclusive of VAT. If a payment fails, you are notified and given the chance to fix it; if payment remains outstanding, we pause the account until payment is made. Measurements not carried out during that pause are not made up and not billed.

4. Cancelling and terminating

A monthly subscription can be cancelled per month via the Stripe customer portal in the app. A yearly commitment is entered into for at least twelve months and cannot be cancelled or reduced in the interim; the monthly invoices continue for that year. You can cancel in the app effective at the end of the current year; without cancellation the commitment renews per year. After cancellation the subscription runs until the end of the paid period; any remaining measurements stay valid afterwards. There is no notice period and no phone call required.

We can block or terminate an account in the event of misuse, payment arrears, or if the usage harms us or others. On a block for misuse the remaining balance lapses; in other cases we refund the unused part of the current month. If we ever discontinue Geony as a whole, you will hear about it at least three months in advance, retain access until then to export your data, and get any unused balance back.

5. What we guarantee, and what we do not

We make every effort to keep the service available and the measurements correct, but give no availability guarantee: the service relies on the APIs of external AI providers, and if those falter, our measurements falter too. Skipped or failed measurements are not charged. Measurement outcomes are descriptions of the behaviour of AI assistants at the moment of measurement; we never guarantee a position, mention or commercial result.

Recommendations and work lists in the service are advice: you decide yourself whether and how you carry them out. Geony never carries anything out for you automatically, and an implemented recommendation guarantees no result. You are responsible for the implementation and for its consequences.

Force majeure releases us from our obligations for as long as it lasts. By that we mean anything reasonably beyond our control: outages at AI providers, hosting or network failures, attacks on our systems, and new legislation or provider terms that make measuring impossible or unreasonably expensive. If force majeure lasts longer than thirty days, both of us may cancel and we refund the unused part of the current month.

6. Liability

You use Geony at your own risk. We are not liable for damage arising from use of the service, from measurement outcomes, reports or recommendations, or from the temporary or permanent unavailability of the service. This applies to direct and indirect damage, so also to lost revenue, reputational harm, lost data and decisions you have made on the basis of Geony. The only exception is damage caused by our intent or conscious recklessness; the law does not allow us to exclude that liability, so we do not exclude it.

If a court rules that this exclusion does not hold in a specific case, then our liability is limited to direct damage and to the amount you paid to Geony in the twelve months preceding the damage-causing event. A claim must in any case be reported within twelve months after you discovered the damage; after that it lapses.

Conversely, you indemnify us against third-party claims arising from your use of the service: for example a competitor objecting to what you measure, or a customer of yours taking issue with a report you shared under your own name.

7. Agencies and white-label

Agencies may use Geony under their own name and logo for their clients and resell the service as part of their own offering. The rule is: the agency is our customer, the agency's client is not. We have no agreement with and no obligations towards that end client. The agency sets its own prices, promises and terms towards end clients and stands behind them itself, including for promises that go further than what we guarantee. Claims from end clients go to the agency, not to us, and the agency indemnifies us against them.

If an agency processes personal data of its own clients or leads through Geony, for example via the free check on its own domain or the lead inbox, then the agency is the data controller for that and we are the processor. For that our data processing agreement, which forms part of these terms, applies automatically.

8. Your data, our data

What you set up (questions, brands, competitors, business context) and what we make from it for you (measurements, reports, work lists) is yours. You may freely use, share and take it with you; on leaving you export everything as CSV. You do warrant that what you enter infringes no one else's rights and that you are allowed to have your brands and questions measured.

The answers from AI assistants that we collect for you are statements by those assistants, not by us. We do not vouch for their accuracy and you do not present them as statements by Geony. Rights to those answers lie where the provider in question places them.

We may use measurement data in anonymised and aggregated form, so without your account, brand or customers being identifiable, to improve the service and to publish market insights, such as a visibility index per sector. The software, the method and the models behind Geony remain ours.

9. Data privacy

How we handle personal data is set out in the privacy policy. After your account is deleted, we delete your data according to the periods in that policy.

10. Changes, prices and law

We can change these terms and our prices. We announce substantive changes at least thirty days in advance by email. If you continue to use the service after the effective date, you agree to the change; if you do not want that, you cancel free of charge before that date and your subscription ends on the old terms. Changes required by law or that are solely to your benefit can take effect immediately.

These terms are governed by Dutch law; disputes are submitted to the competent Dutch court. If a provision turns out to be invalid, the rest remains in force and we replace that provision with something that comes as close to it as possible. Questions: hallo@geony.ai.
